1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Vuoly website located at https://www.vuoly.com (the "Website") and mobile applications (the "Apps"), collectively referred to as the "Services," offered by Vuoly, a company incorporated in the state of Delaware, United States of America ("Vuoly", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of these Terms, you are not authorized to use the Services.

2. Description of Services

2.1 eSIM Reselling

Vuoly resells prepaid eSIMs from various network providers. You can register, browse available plans, and purchase eSIMs directly through the Website or Apps. Our payments are processed securely by trusted partners like PayPal and Stripe.

2.2 User Accounts

To use certain features of the Services, you will need to create an account. You are responsible for maintaining the confidentiality of your login information and for any activity that occurs under your account.

3. Device Compatibility

You are responsible for ensuring your device is eSIM compatible and network-unlocked before purchasing an eSIM. A list of compatible devices is available on our website for your reference. The list of compatible devices is subject to change based on updates from device manufacturers. It’s your responsibility to check compatibility at the time of purchase. By confirming your device's compatibility during checkout, you acknowledge the accuracy of this information.

4. Use Restrictions

You are prohibited from:

  • Engaging in any activity that disrupts or interferes with our Service.
  • Circumventing or attempting to circumvent any filtering, security measures, or other features designed to protect our Service or third parties.
  • Using the Service for any unlawful purpose.

When the Customer breaches its obligations, Vuoly may suspend the Customer's use of the Service. During any period of suspension, the Customer shall continue to pay all Charges due under this Agreement in respect of the suspended Services.

5. eSIM Activation and Use

The activation process and data validity period for each eSIM plan may vary depending on the provider. We will provide you with clear instructions for activating your eSIM after purchase. Please note that Vuoly is not responsible for any issues arising from network connectivity or service limitations imposed by the underlying network provider.

6. Charges and Payment

6.1 Supported Payment Methods

We accept various payment methods, including credit/debit cards, PayPal, Google Pay, Apple Pay, and Alipay. The currency of payment is US Dollars (USD).

6.2 Charges for Use

All Vuoly prices are listed in USD and are inclusive of VAT unless otherwise specified. You are solely responsible for any additional charges incurred from your mobile service provider for using the eSIM plan.

7. Refunds and Cancellations

7.1 Refund Eligibility

You may request a refund or eSIM replacement if you cannot install and use the eSIM due to a technical problem directly attributable to Vuoly.

  • Refund requests must be made within thirty (30) days from the date of purchase.
  • You must cooperate with our troubleshooting efforts to identify the technical issue. Depending on the nature of the issue, Customers will be asked for further information such as screenshots of the device settings for technical issues.
  • Refunds will not be granted for expired data packages or user error during installation.

7.2 Non-Refundable Purchases

  • Accidental purchases: Once you install the eSIM, it will be considered used, and no refunds will be offered.
  • Fraudulent purchases: Vuoly reserves the right to refuse a refund if there is evidence of fraudulent activity or misuse of our Services.
  • Incorrect charges: If you believe you have been incorrectly charged, please notify Vuoly within twelve (12) days of receiving the invoice.
  • No refund or remuneration of any kind will be issued due to charges from use of alternate phones, alternate SIM cards, alternate providers, hotel phones, or other charges that are not directly linked to the Customer's Vuoly eSIM account.

7.3 Refund Process

To request a refund, please contact our support team via the Contact Us page or email. We will review your request based on the criteria outlined above. If a refund is approved it will be credited to the original payment method. Once a refund is approved and issued, it can take up to thirty (30) business days to appear on a statement depending on the bank.

8. Intellectual Property

All intellectual property rights in the Service and its original content, features, and functionality are and will remain the exclusive property of Vuoly and its licensors.

9. Third-Party Services

Our Service may contain links to third-party web sites or services that are not owned or controlled by Vuoly. Vuoly assumes no responsibility for the content, policies, or practices of any third party web sites or services.

10. Limitation of Liability

Vuoly is not liable for detriments arising from the Services' unavailability or network service disruptions. Vuoly cannot provide any guarantee of constant availability of the network service. Vuoly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Termination

Vuoly may terminate your account or suspend your access to the Services at any time for breach of these Terms or violation of applicable laws. You may also terminate your account at any time.

12. Indemnification

You agree to defend, indemnify, and hold harmless Vuoly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least [number] days' notice prior to any new terms taking effect.
